ORDER OF NONSUIT SIGNED – WITH PREJUDICE (12/20/2023)

Motion to Release Temporary Restraining Order Bond – BUT why is the proposed order restricted?

Delarogue gets his commission for investor flippin’ the distressed homeowners property which he’s snatched.

There’s the shy buyer: 19322 Forest Fern Trust and PO Box, which leads back to “Jimmy Au [aka Thai Trung Jimmy Au]” as trustee and a sale for $10 from plaintiff, who signed his affidavit in front of a notary in Florida on March 1 of 2024.

Whether the loans are all paid off is unknown, there’s the “4th lien” deed of trust for $35k which mentions the main mortgage, but there’s no release of the mortgage on HC RPR.

It would appear they’ve ‘assumed’ the existing liens, but whether that was with or without consent from Idaho is unknown.

POLK, SHANNON MICHELLE (PRO SE) vs. IDAHO HOUSING FINANCE ASSOCIATION

 (Court 129, JUDGE MICHAEL GOMEZ)

SEP 1, 2023 | REPUBLISHED BY LIT: NOV 20, 2023
NOV 20, 2023 SEP 12, 2024

Pro se Polk claims to have a buyer ready but did not provide a contract. She avoids claiming this home as her homestead in her detailed petition with enclosures, and there’s no update on her purchase from the Bowers on HCAD, although real property records confirm the same. Notably, there is no request for issuance of service, so we’ll wait and see if the mystery buyer appears in public records in due course.

Above is the date LIT Last updated this article.

The case remains open despite there being no movement since obtaining the $100 TRO.

Harris County RPR shows a March 2024 assignment of deed of trust naming Polk as borrower and HCAD is now updated to reflect she’s the homeowner.

Idaho assignment to Mers recorded March 2024.

Whether she’s still delinquent on her mortgage is unknown.

Because Mr. North has failed to respond to the Clerk’s 3 Notice of Filing Fee Due issued on December 20, 2022, as an alternative and in addition to being dismissed for failure to establish federal subject matter jurisdiction, this action is DISMISSED WITHOUT PREJUDICE for failure to pay the filing fee.
