HOUSTON LAWYER ERICK JOSEPH DELARUE

At LIT, we are always seeking comments and responses to our recently published and updated articles concerning the extent of the real estate fraud in Texas state and federal courts since the Greatest Theft of Citizens’ homes in American History.

With this in mind, I am including links to two related cases involving “foreclosure defense” lawyer Erick J. Delarue, or Delarogue as we’ve nicknamed him – after he threatened to sue my investigative legal blog for defamation.

Of course, that never materialized – for the reasons we touch on in this email.

I’ve included him in this email thread, as LIT is an open book and transparency is key in all communications, especially when it’s difficult to differentiate between foreclosure defense lawyers, creditor rights lawyers, foreclosure mill lawyers and judges who love real estate.

Returning to the cases at hand, first up is Tracy Wicker, currently percolatin’ at SDTX before US District Judge Keith Ellison. I’m including Gray Burks for North American Savings Bank in this email list.

The second is Kenneth Baucum, Jr. I’m including Quilling’s legal counsel, for JPMorgan Chase.

The articles are self-explanatory, so for now, I’ll just leave it at that.

However, for the record, LIT does have correspondence from disgruntled Delarue clients who believe his candor was questionable, and they were being strong-armed into accepting Moses into their home.

To date, these complaints have not been published.

Good afternoon,

Your email is the first notification that Ranch Country has received regarding a bankruptcy filing. Of note, Ranch Country was not listed as a party in the pleadings and therefore received no notice.

Collections accounts are private and confidential as to the Lot Owner. We can only discuss the account with the Lot Owner and his/her attorney.

Ranch Country has not discussed purchase of the house, nor would Ranch Country do so.  This is a non-profit corporation whose contractual duty requires collection of assessments and expenditure for the community.

Please note, Judgments only include fees owed at the time the Judgment is signed. To collect assessments accrued thereafter requires a separate action, but law.  There is no duplicative or increasing of legal fees.

*Unfortunately, the 2024 lawsuit does not breakdown, nor provide a calculation of what sum is default from the 2021 judgment (with interest and fees) and what amount is 2022-2024.

Without providing legal authority, or statute citation (with the exception of Exhibit B included in the 2024 petition), but taking her response as true, Sarah Gerdes avers that despite seeking a sum far lower than that granted in the 2021 judgment, each year’s HOA assessment and fees have to be sued for separately.

We’ve just published details on this new expedited foreclosure filing by Ranch Country Association’s counsel, the Sears Firm.

By way of background, you’ll note there’s been a hive of activity in recent years regarding this residence.

On Feb 25, 2021 an agreed judgment was entered into by the Arrah’s re debt owed, including an order of foreclosure should that become necessary.

On Aug 25, 2021, Ranch filed its Amended Mgt Certificate, appointing Montage.

On Feb 16, 2024, a motion to sell the home to the HOA/Management was submitted by debtor’s counsel during Sheryll Arrah’s bankruptcy, which would be dismissed shortly thereafter.

On Feb 26, 2024, Ranch filed for expedited foreclosure (736).

On Feb. 28, 2024, Harris County District Court transfer the case to the Court (215) who decided the first HOA suit in 2021.

The main question we have is for Ranch and their counsel. Why file for foreclosure again when you’ve got a valid and subsisting order of foreclosure?

This new civil action will only delay the sale for the HOA, and increase legal costs and fees for the Arrah’s?

(The agreed judgment already had $1,500 tacked on in default of said agreement, now they are facing more legal fees and costs).

The supplementary question is: Did the HOA reach any kind of provisional agreement to buy the home for $195,000 during bankruptcy, or was that just debtor’s suggestion?
