Laws In Texas downloaded the entire docket and scoured for the final sentencing hearing. We were unable to ascertain what happened at the final sentencing, e.g. if Tony Patel was confined to the home for the duration of his sentence due to Covid-19 as he has stated to LIT, and/or why he’s only completed 69% of the 72 month term – by our rough calculation.
Certainly, we were taken aback by the above facts, when it has been said before that federal prison sentences do not come with any ‘good behavior’ credits.
More concerning is the content of Patel’s emails, which confirms he does not believe his punishment was “jail” and he strongly refutes any and all criminal charges and sentences applied to him.
Pritesh Patel is taking no accountability for his fraud on the IRS.
We strongly reject his assertions and why we believe he is a risk to to the community – per the release order (probation), which commences on May 2, 2022, as signed by Judge Pittman.
Tony Patel was also sentenced to 1 Year Probation, after his 72 month custodial sentence, which is commencing;
Wednesday, May 2, 2022, e.g. way before the 72 month federal criminal sentence is due to expire. It equals:
4 years, 2 months, 4 days excluding the end date.
Or
50 months, 4 days excluding the end date.
which means Tony Patel served only 69% of his ‘sentence’.
As per a signed order by Judge Mark Pittman, NDTX who replaced Judge John “Hang ’em High” McBryde.

Federal Bureau of Prisons and Home Confinement
Home confinement refers to any judicially or administratively imposed condition requiring a participant to remain in his or her residence for any portion of the day.
Home confinement may be monitored with the assistance of electronic equipment or without it and may be imposed as an alternative only to incarceration (Home Confinement Policy Manual, 1991).
The goal of home confinement, like that of prison or jail, is to restrict an individual’s freedom to a particular location, in this case the home.
Electronic monitoring involves the use of a technological device to verify that offenders are at designated locations at specified time periods.
Most electronically monitored programs are used as probation or parole conditions.
When used as a condition of probation (at the front end of the sentence), a judge will usually sentence a non-violent offender to home confinement with the use of electronic monitoring instead of a period of incarceration.
At the back end of the sentence, home confinement with electronic monitoring allows for the early release from prison (between 60 to 180 days) and is used as a condition of parole.

Pritesh Patel pled guilty to two counts of aiding and assisting in the preparation of false tax returns. On appeal, his only claims of errors concern his sentence. He challenges the district court’s application of the sophisticated-means enhancement and its calculation of tax loss. We AFFIRM.
