After the 5th Circuit Shorts Out the Appeal in a July 2018 Opinion, the First Legal Attempt to Foreclose in Late 2021 is Abandoned.

In March 2017, Defendant-Appellee Deutsche Bank National Trust Company (“Deutsche Bank”) obtained a judicial order for foreclosure.

In Dec. 2021, more than 4 years later, Deutsche Bank filed for an expedited 736 foreclosure. Even taking allowance for a TRO, this attempted foreclosure is time-barred. Perhaps that is the reason James Frappier of BDF Hopkins for Deutsche Bank nonsuited.

Either way, there’s nothing on the public records to show that there was any further bankruptcies or other reason why it is not time-barred.
