So here we have the foreclosure scam squad, comprising of Brewer, Vilt and DeLaRue, et al, cornering their prey, John Klander.

According to the plaintiffs’ petition, Mr. Brewer approached Mr. Klander with a scheme to avoid the foreclosure—Mr. Brewer would purchase the property from Mr. Klander, pay off the loan, and rent the property back to Mr. Klander.

They allege Mr. Klander executed a deed conveying the property to a trust controlled by Mr. Brewer

(in violation of the deed of trust),

but no attempt has been made to pay off the loan.

Instead of paying off the loan, Messrs. Klander and Brewer filed suit claiming the foreclosure sale should not occur because Mr. Klander had not been provided proper notice.

They obtained an ex parte temporary restraining order enjoining the sale. (TRO.)

The sale did not occur.

It would appear, from the information available, the foreclosure scam squad bailed on their false promises to purchase the home and rent it back to Klander – and they backed down quickly after Akerman’s summary judgment statements intimating what LIT is sayin’, it was a criminal and fraudulent conveyance for no monetary consideration.

Ultimately, it would appear Klander’s home was sold by New Penn/Ackerman at foreclosure, and purchased by Echostate Solution Inc.

Echostate filed to evict Klander which would be dismissed early December.

Then you’ll note Vilt wants his $700 bond money returned, with interest, in January 2019.

Shortly after, Echostate flips the newly acquired home, purchased at auction, to another REI, Tomas Hernandez, via Nydia Hernandez.

This is irrefutable evidence of the repetitive criminal acts of the foreclosure scam squad – as touched on by the lawyers for Akerman in their motion for summary judgment – but who also failed to report Vilt and DeLaRue to the State Bar of Texas, which is also sanctionable conduct.

SUMMARY JUDGMENT, ACKERMAN

This lawsuit is nothing more than a disingenuous attempt to stall foreclosure.

Plaintiffs’ claims base solely on their allegation Shellpoint failed to provide Mr. Klander, the borrower, with notices required by the loan agreement and the Texas property code to conduct a non-judicial foreclosure sale.

The evidence demonstrates their claims are meritless.

For this, and the other reasons below, Shellpoint is entitled to judgment on each of plaintiffs’ claims.
