Former Central Texas judge gets 9 months for theft

WACO, TX — An ex-judge judge already on probation in a mileage reimbursement scam must serve nine months in federal prison for stealing a dead Texan’s Social Security benefits.

Jean Laster Boone was sentenced Wednesday in Waco.

Boone in September pleaded guilty to theft of government property. Boone, who in October 2013 resigned as a McLennan County justice of the peace, was also fined $5,000.

Robert Martin Davis died in 2010. Boone, who was a longtime friend, had power of attorney for him and access to his bank account.

The Social Security Administration continued to deposit his benefits until October 2013. Boone earlier this year repaid about $16,000 in embezzled funds.

Boone last December received three years of probation after pleading guilty to record tampering over falsifying county mileage documents for maximum reimbursement.

In Waco today, 60-year-old former McLennan County Justice of the Peace Erma Jean Laster Boone was sentenced to 9 months in federal prison in connection with a scheme to steal Social Security Income benefits announced United States Attorney Robert Pitman.

In addition to the prison term, United States District Judge Walter S. Smith, Jr. ordered that Boone pay a $5,000 fine and be placed on supervised release for a period of three years after completing her prison term.

On September 11, 2014, Boone pleaded guilty to theft of Government property.

According to court records, Robert Martin Davis died on May 27, 2010, and the defendant was the reporting party on Davis’ death certificate.

From Davis’ death until October 2013, the Social Security Administration continued to deposit Social Security benefits, which totaled approximately $63,000, into Davis’ bank account.

The defendant had access to Davis’ bank account.  Boone admitted to authorities that she spent over $16,000 from Davis’ account on “fixing stuff up around the house.”

In March 2014, Boone paid back to the Social Security Administration the money she had fraudulently embezzled and used.

This investigation was conducted by the United States Social Security Administration, Office of Inspector General.

Assistant United States Attorney Greg Gloff prosecuted this case on behalf of the Government.

Hopkins County Woman Indicted for Social Security Fraud

SHERMAN, Texas – A 51-year-old Sulphur Springs, Texas, woman has been indicted for federal violations in the Eastern District of Texas, announced U.S. Attorney Joseph D. Brown today.

Theresa Renee Coburn was named in an indictment returned by a federal grand jury on Mar. 14, 2019, charging her with theft of government property.

According to the indictment, from about December 2005 through October 2015, Coburn is alleged to have provided fictitious documentation to the Social Security Administration Disability Program in order to fraudulently receive benefits totaling $42,378.00 on behalf of a child that did not live with her, and did not receive support from her, during that time.

If convicted, Coburn faces up to 10 years in federal prison.  A grand jury indictment is not evidence of guilt.  A defendant is presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

This case is being investigated by the Social Security Administration Office of the Inspector General and is being prosecuted by Assistant U.S. Attorney Matt Johnson.
