The last of many bankruptcy filings by Dennis James Turner commenced in 2019 and terminated Jan 19, 2021.
Then he sued PHH pro se in federal court on Sept. 2021, who were represented by Dykema. The case would be dismissed with prejudice on March 17, 2022.
Nearly 3 years – 33 months have passed – and the Turner residence is still the Turners’ according to real property tax records and no further bankruptcy filings necessary.

Another Dykema foreclosure appears to have stalled post judgment, after Judge Al Bennett’s judgment in March of 2022, dismissing the homeowners’ claims, with prejudice.

MARCH 17, 2022: JOINT STIPULATION OF DISMISSAL WITH PREJUDICE PURSUANT TO FRCP 41(a)(1)(A)(ii)
Plaintiff, Dennis J. Turner (“Plaintiff”), and Defendants, PHH Mortgage Corporation and Ocwen Loan Servicing LLC (“PHH MC” and “Ocwen”, collectively “Defendants”)1 (Plaintiff and Defendants collectively, “Parties”), hereby file their Joint Stipulation of Dismissal With Prejudice Pursuant to Fed. R. Civ. P. 41(a)(1)(A)(ii), and in support thereof would respectfully show the Court the following:
1. The Parties hereby jointly stipulate to dismiss the above civil case, and all claims asserted therein, with prejudice to refiling the same, pursuant to Fed. R. Civ. P. 41(a)(1)(A)(ii).
2. The Parties also agree that all costs of court and attorney’s fees incurred shall be borne by the Party incurring the same.
WHEREFORE, Plaintiff and Defendants hereby jointly stipulate and request that the Court enter an Order dismissing the above civil case, and all claims asserted therein, with prejudice to the refiling of the same, and for such other and further relief to which the Parties may be justly entitled.

Jan 4, 2022: Continuance granted by Judge Bennett as ‘settlement’ expected in this pro se foreclosure case. 60 days allowance to wrap up another PHH Ocwen case via settlement, which is trending in SDTX of late.
Dec 14, 2021: Scheduling Order signed by Judge Bennett on Dec, 13, uploaded on 14th to Docket, 4 days after hearing. PHH Ocwen filed a MOTION TO DISMISS FOR FAILURE TO STATE A CLAIM on Oct 22, and Turner filed a FIRST amended complaint on Nov. 23. No rulings on any motions were made at the conference by the court.

So the ‘blind draw’ gives Bennett a PHH Mortgage Corp and Ocwen federal case assignment, once again. The odds of that happenin’ are mighty slim and so y’all can see its’ a federal setup. We’re waitin’ to see which law firm is going to appear for PHH in the case of Turner and if the pre-Christmas party is scheduled thereafter for all the banksters, errr, judges and the foreclosure mills after closin’ of the gavel.
