LIT COMMENTARY & UPDATES
LIT: NOV 28, 2024
Not for the first time, and certainly not the last, we are seeing a troubling and targeted pattern of selective foreclosure practices in Texas courts and within the legal profession—practices that seem to disproportionately benefit Black American families, allowing them to avoid foreclosure.
In this particular case, the home wasn’t even flagged for foreclosure for the first seven years, despite the mortgage remaining unpaid since 2010.
Yet, fourteen years later, Patricia Doran (also known as Patricia Garber) still retains ownership, and no foreclosure proceedings have been initiated, despite the outstanding debt.
This pattern raises significant questions about selective targeting and discriminatory practices.
In this instance, Deutsche Bank’s involvement suggests that certain borrowers—often from marginalized communities—are being allowed to evade foreclosure, perhaps due to factors unrelated to the property’s financial standing.
This case is not unique.
Families like the Garbers appear to benefit from certain family connections that may influence how lenders and foreclosure mills handle their cases.
For example, Annette Garber, a family member, works as a media specialist at Methodist Hospital and until recently, HCA Healthcare as their Media Director.
Similarly, in the Sewing case we’ve discussed on LIT, Sarah Sewing, the first Black American journalist hired by the Houston Chronicle, with strong connections to the Mayor of Harris County seems to be afforded similar protections.
These professional roles, in sectors like healthcare and journalism, suggest that family connections or professional standing may be playing a role in whether foreclosure actions are pursued.
It is a pattern that raises critical questions about fairness and equity in the foreclosure process—questions that we continue to monitor closely.
On Monday, Feb. 15, Houston Methodist Baytown Hospital held an event honoring Dr. Martin Luther King, Jr. Employees came together to help our community with access to food and basic essential items. Nearly 4 million people in Texas experience food insecurity. The food drive at the hospital was held from Jan. 15-22 and items were delivered to Bay Area Homeless Services on Wednesday, Jan. 24. Houston Methodist Baytown came together to benefit the community supporting Dr. King’s passion for helping those in need.

Claims property is her homestead, but HCAD would suggest otherwise.
LIT COMMENTARY
Now, remember, there’s a foreclosure defense lawyer who’s a legal bandit called James Minerve who represented Doran.
Meanwile, its Despicable Damian for DBNTCO, former BDF attorney who was sacked after his discriminatory Facebook page posts were disclosed by John and Joanna Burke in their Deutsche Bank case.
He moved to HWA where he filed this super-sized motion for summary judgment in the Holcomb case (without leave of court) and which has been used to steal citizens homesteads – as it completely misapplies Texas property laws and misinterprets statutes.
