Upon further investigation, there was an earlier case filed by Zions dba Amegy Bank v Boone and which was fully litigated before Judge Beau Miller from Nov 22, 2021 – Mar 1, 2023. A judgment allowing non judicial foreclosure was granted. Despite this, DeLaRogue filed suit Mar. 6.

In Delarue’s petition, he admits to Boone’s disclaimer but then claims no knowledge of the judgment of foreclosure, a contradiction. As at July 30, 2024, there is no Trustee’s deed on file at Harris County real property records indicating foreclosure of the home per the judgment in hand. Indeed, the latest $10 fraudulent transfer is from Flywheel to Eric Guzman, recorded Jun 5, 2024, which indicates that the ownership of the property is still contested.

This case would be non-suited without prejudice on 18/19 April, 2023…same date as our last update.
We’ve combined the complaint and verification with TRO here.
So after we highlighted the corrupt PDF issue, the sales contract, exhibit 1 was corrected and we can now view it.
First, the buyer is an LLC which is forfeited for not filing franchise tax returns.
Secondly, the contract is not properly executed.
