LIT’s research and article came about after Judge Phillips restricted a pro se’s response from the public. That triggered our interest, and we reviewed the restricted documents, which were made available after the defense removed the State complaint to stop a wrongful foreclosure to the federal courthouse in Houston.
What LIT read was shocking.
The acts of the representative who visited the Carmon residence were illegal and unlawful by trying to serve a 3-day notice of eviction, without going through the correct legal procedure. That stated, the foreclosure auction should not have been held as there was a court ordered TRO already in force and the individual for Alpha would have clearly known the facts, based on their obvious experience in this vertical.
The plaintiffs also allege trespassing and impersonation of a peace officer, which is a criminal act.
