How Difficult is it Texas to Do a 3rd Party Debt Collector Surety Bond Check with the TX Secretary of State?
Answer: It wouldn’t be difficult at all, but it would mean lawyers complying with Texas law and courts having to apply the law, something they refuse to do.
FIRST PORTFOLIO VENTURES I, LLC ARE VIOLATIN’ TEXAS LAW
Watch this video, it is the exact scenario here. First Portfolio is the Plaintiff, who does not hold an active Surety bond in Texas. They hire lawyers Javitch Block, who are actively bonded in Texas, so the Plaintiff thinks this is enough to get around the bond requirement, per Texas Finance Code 392. They are wrong.
Javitch Block, LLC, does have an Active Surety Bond in Texas.
First Portfolio Ventures I, LLC is a debt buyer, a 3rd party debt collector who is required by Texas law to have an ACTIVE Surety Bond in Texas before suing you. They don’t.
First Portfolio Ventures I, LLC sues consumers, like Tara Butler in this case, that default on balances that they purchased for pennies on the dollar.
They make money by collecting more than they paid for the debt and counting on the fact that you will not respond or show up to court.
If you do not then they may take a default judgment against you.
