JOHNS, ELDON vs. BERLETH, ROBERT W
(Court 157, Judge Tanya Garrison)
28 Feb 2022 | Republished 17 Jun, 2022
Rule 11
JOHNS LAWYER; My client has been forced to seek bankruptcy protection. As a result, he is willing to sign a mutual release with Mr. Berleth and nonsuit all claims, provided Mr. Berleth also signs the release on behalf of himself and his firm. Please let me know if we can do this.
BERLETH LAWYER; I have forwarded the offer to my client. While your communication only mentions Mr. Berleth, I am operating under the assumption that the release would be towards both Robert W. Berleth and Berleth & Associates, PLLC. Please advise if that is not the case.
JOHNS LAWYER; Yes, the proposed mutual release would resolve all claims by all parties in this case.
BERLETH LAWYER; Agreed. Will Mr. Johns be able to execute an enforceable release if he has filed for bankruptcy protection?

LIT would assume he’s back at the original address,
6731 Apple Valley Ln, Houston, TX 77069
which appears to be a relative, e.g. parent or family member.
We say that in the belief his credit and FICO won’t be great, especially when you read the Montana rental home case in 2018, which follows.

“…the court is not fooled…by the disingenuous Berleths’…”
Rideg v. Berleth, ( Montana Supreme Court, Aug. 25, 2020)
Upon our review of the record, we are troubled by the inaccuracy of many of Robert’s factual
and legal representations here and below as a self-represented litigant but licensed member of the Montana Bar.
While we generally give wide latitude to self-represented litigants, we caution
Robert to be more cognizant of his professional duties before the courts of this State.
See M. R. Pro. Cond. 1.1, 1.3, and 3.3 (competence, diligence, and candor to the tribunal).

I knew him personally, He said he will help me with a legal matter. He played around for a year only to completely scam me and remove himself from the case that was a “Done deal. I knew his character was shady from our time together but I had no where to turn and maybe still my fault but he’s a scam.
