We’ve scoured for an update on this ethics complaint against Attorney General William “Bill” Barr, as the Bar inquiry stage is 30-45 days. Well, we’re now in excess of 2 months and it appears nobody has any update as to whether Barr has to answer the Bar complaint or if it has been dismissed.
Why 27 Distinguished DC Lawyers Filed a Complaint with Bar Association Against Attorney General Barr

It has been deeply disturbing to witness Attorney General William Barr persistently acting to undermine the rule of law over the past sixteen months. The administration of justice depends on lawyers honoring their ethical duties and playing by the rules, so the public can have confidence in the fairness and impartiality of our legal system.
As Massachusetts Attorney General, I was always mindful that the office I had the privilege to hold cast a far longer shadow than my own. My conduct mattered because the top legal officer of a state – or the federal government – is inherently obligated to serve as an institutional model for prosecutors, other lawyers, the public and the rule of law.
The organization I co-founded less than two years ago, Lawyers Defending American Democracy (LDAD), is dedicated to these same ideals.
Accordingly, LDAD is proud to have two members of its Steering Committee as signers along with the 25 other distinguished non-partisan leaders and members of the DC Bar who today filed an ethics complaint against Mr. Barr. This is a meticulously researched legal brief that describes in painstaking detail how Mr. Barr has violated his attorney’s oath of office and rules of professional conduct.
That complaint asks the DC Bar’s discipline office to investigate Mr. Barr’s alleged ethical violations and determine what sanctions would be appropriate.
The complaint is a sober and comprehensive “bill of particulars.” It challenges Mr. Barr’s actions as to four basic matters:
1. Unconstitutionally ordering, overseeing and supporting the forcible dispersal of constitutionally protected peaceful protests at Lafayette Square. In so doing, Mr. Barr unethically represented Mr. Trump’s personal interests in a “photo op” rather than carrying out his ethical duty to represent his client — the people of the United States — to protect their fundamental interest in their constitutional rights.
2. Misleading Congress and the public by asserting that the Mueller Report did not contain sufficient evidence to establish that President Trump committed the crime of “obstruction of justice.”
3. Deceiving the American people in his unprecedented December 2019 attack on a report from a Justice Department Inspector General. Mr. Barr misrepresented the IG’s determination that the FBI had a proper basis for launching its 2016 counterintelligence investigation — by leaving out crucial evidence on which the IG relied.
4. Issuing harmful and totally unnecessary public prejudgments of FBI personnel during a pending criminal investigation he was overseeing in which they were potential defendants – seriously interfering with the administration of justice.
All of these matters are part of Mr. Barr’s pattern of placing the president’s personal and political interests ahead of his ethical duty to represent the interests of the United States in dispensing evenhanded justice under the rule of law and upholding the Constitution.
Sober and highly experienced lawyers like those who signed the complaint wouldn’t take such an action except in extraordinary circumstances. It is only because Attorney General Barr’s abuses are so serious, so repetitive, and so well documented in the complaint that the signers felt compelled to hold Mr. Barr accountable — to protect the integrity of the legal profession and the American legal system.
Among the remarkable list of signers are four former DC Bar Presidents – former leaders of the organization they now call upon to investigate Mr. Barr – and a former DC Bar senior discipline lawyer, now ethics counsel to Georgetown University’s Law Center. Signers include former Watergate prosecutor Philip Lacovara (who argued and won U.S. v. Nixon in the U.S. Supreme Court) and former Justice Department prosecutor Paul Butler, now a law professor, who knows what is required for ethical behavior by Justice Department lawyers. Also among the signers are former law school deans, eminent legal ethics professors, and distinguished former government officials.
If establishment lawyers can issue this exceptional call for accountability, Congress should heed the call and question Mr. Barr about the specific ethical violations charged, when he testifies next week. Bar associations and lawyers around the country should discuss the complaint and demand the application of professional standards to the U.S. government’s top lawyer.
The public should not stand for more of this misconduct in the Attorney General’s office. At the least, this bar action may help to deter such actions for the balance of Mr. Barr’s tenure.
Bill Barr Racks Up Yet Another Bar Complaint

Attorney General Bill Barr may be popular inside the Fox News bubble, but among members of the legal profession he ranks somewhere between psoriasis and The Clap.
In October, the New York City Bar Association published an open letter accusing Barr of breaching professional ethics in the Ukraine scandal and calling for him to face sanctions if he failed to recuse himself from the impeachment investigation. In June, George Washington University Law School’s faculty tried to get Barr’s honorary degree from 1992 revoked after he teargassed peaceful protesters so the president could shoot Bible porn in front of a boarded up church.
And now a group of 27 distinguished lawyers has written a letter to the Office of Disciplinary Counsel of the D.C. Bar urging it to “commence an investigation to determine whether Mr. Barr, who is a member of the DC Bar, should be subject to disciplinary action under the Rules.”
“It has been deeply disturbing to witness Attorney General William Barr persistently acting to undermine the rule of law over the past sixteen months,” former Massachusetts Attorney General Scott Harshbarger, founder of Lawyers Defending American Democracy, wrote in Just Security. “The administration of justice depends on lawyers honoring their ethical duties and playing by the rules, so the public can have confidence in the fairness and impartiality of our legal system.”
Harshbarger and his fellow signatories, including four past presidents of the D.C. Bar, accuse the Attorney General of betraying his ethical duty to the American people in service of Donald Trump’s venal, personal ends.
Mr. Barr’s client is the United States, and not the President. Yet, Mr. Barr has consistently made decisions and taken action to serve the personal and political self-interests of President Donald Trump, rather than the interest of the United States.
They charge Barr with four “Counts” of impropriety:
Misrepresenting the findings of the Mueller Report by falsely claiming that it found no grounds to charge the president with obstruction of justice, rather than acknowledging that the memo presented copious evidence of obstruction, but deferred the charging decision to congress as part of its impeachment power;
Falsely implying that the Inspector General’s report on Russian interference in the 2016 and outreach to the Trump campaign was a “witch hunt” which lacked appropriate predication;
Making inappropriate public statements prejudging the outcome of the Durham investigation and denigrating the conduct of FBI agents; and
Violating the First and Fourth Amendment rights of protestors in Lafayette Park by illegally dispersing them for Trump’s Bible-toting photo op.
This is a long, long letter.
Even longer than the unsolicited memo Barr sent the president in 2018 explaining how Article II gives the president the right to order the Justice Department to investigate his political enemies, the one that convinced the president to give him Jeff Sessions’s old job.
In some sense this complaint is purely performative — the D.C. Court of Appeals is not going to initiate disbarment proceedings against the sitting Attorney General in the middle of an election.
But at the same time, it’s critically important that we as lawyers stand up and protest as Bill Barr burns down the Justice Department, cooks up bogus investigations of Trump’s political enemies, and torpedoes cases against the president’s friend.
As the letter notes:
The DCRPC and Disciplinary Rules reflect the norms and expectations about the conduct of lawyers in our society.
Importantly, Mr. Barr, as our chief law enforcement officer, occupies a position that serves as a model for other lawyers, particularly government lawyers.
Thus, serious ethical deviations on his part carry enormous consequences for our profession as a whole.
Where a lawyer in Mr. Barr’s position has violated the basic standards of honesty, trustworthiness, and other guideposts of ethical conduct governing lawyers, the Office of Disciplinary Counsel is in a unique, independent position to investigate his conduct.
If not us, then who can take a stand and say, “This is not okay?” Because it really, really isn’t.
Open Letter Supporting the 100,000 Lawyers, Agents, and Staff Members of the U. S. Department of Justice
If you currently are, or previously were, a member of the Bar, we encourage you to affirm your support of the tens of thousands of dedicated DOJ employees by adding your name to this letter.
We, the undersigned, are attorneys from across the political spectrum and across the country. We write to express support for Department of Justice (“DOJ”) professionals who may face difficult choices about participating in political misuse of the DOJ in the election period ahead. The public and these professionals should know that if they stand up to such misuse — whether via resignation, public statements, or other forms of expressive dissent — they will have broad support in the legal profession, whose best traditions they will be upholding.
By word and deed, Attorney General Barr has demonstrated a willingness to politicize the DOJ by backing and helping to implement the President’s most partisan and extreme views. Mr. Trump’s refusal to commit to a peaceful transition of power – even if solely intended as another effort to discourage voters – heightens our concern about what actions the Attorney General might take that would undermine the vote and the rule of law.
The Department of Justice is a cornerstone of our legal system. Trust in its fairness and impartiality requires an Attorney General singularly dedicated to the principles espoused on its own website:
Thomas Jefferson wrote, “The most sacred of the duties of government [is] to do equal and impartial justice to all its citizens.” This sacred duty remains the guiding principle for the women and men of the U.S. Department of Justice.
Attorney General Barr’s prosecutorial actions supporting the President’s friends and partisan interests have eroded public confidence in his commitment to impartial justice for all people. Earlier this year, Barr’s intervention in DOJ cases against presidential allies Roger Stone and Michael Flynn prompted more than 2,000 DOJ alumni to speak out in protest.
In July, twenty-seven distinguished DC Bar members filed a disciplinary complaint against Mr. Barr.
Among other things, the complaint cited his misrepresenting the law in Senate testimony defending his decision that the Mueller Report’s evidence was insufficient to charge the President with obstructing justice.
The complaint also charged him with violating his lawyer’s oath to uphold the Constitution when he oversaw the use of force against peaceful protestors in Lafayette Square. The complaint stated that:
“Mr. Barr has consistently made decisions and taken action to serve the personal and political self-interests of President Donald Trump, rather than the interest of the United States.”
As the election approaches, Mr. Barr has increasingly politicized the DOJ with his public pronouncements and actions:
On September 14, he stated: “As an attorney general, I’m not supposed to get into politics.” He then immediately undermined that standard: “We [are] going to find ourselves irrevocably committed to the socialist path . . . if Trump loses this election. . . .”
On September 16, The New York Times reported that Attorney General Barr had asked DOJ prosecutors to consider filing criminal charges against the Seattle Mayor, whom President Trump had attacked for allowing a police-free zone to help calm unrest.
On September 17, Barr embraced one of the President’s chief campaign themes with a shocking statement, asserting that state stay-at-home measures to control coronavirus spread constituted the “greatest intrusion on civil liberties” in history “other than slavery.”
On September 23, Barr dishonored constitutional checks and balances by blocking DOJ officials from appearing before Congress because House Judiciary Committee Democrats had been “scolding” him at his July 28, 2020 testimony.
Further, DOJ’s impartiality has traditionally meant avoiding actions shortly before elections that might affect the outcome. Mr. Barr has indicated that he is poised to abandon that tradition by pressing his hand-picked prosecutor, John Durham, to issue an irregular “report” with partisan impact within weeks of the election.
Additionally, Mr. Barr’s statements raise grave concern about his readiness to influence the upcoming election. He has defended the President’s threat to send law enforcement to polling places — historically done to intimidate voters. Barr’s endorsing the President’s unfounded mail-in ballot fraud claims raises red flags about potentially using DOJ in post-election litigation to undermine the vote.
We support DOJ attorneys and personnel who stand by their oaths and the Department of Justice’s duty to do justice for the public by not participating in partisan misuse of the DOJ. They honor the rule of law, our profession, and the country as we face this crucial test for our democracy.
