This 2022 case stems from a 2015 case before former state judge Al Bennett, which was dismissed on January 29, 2024.

However, a new order reinstated the case in April 2024.

This foreclosure case is now time-barred, with a 4-year limit on such actions.

DBNTCO failed to act within the required time frame (“slept on its legal rights”) and is being granted rights it no longer holds, a decision made by District Judge Fredericka Phillips, contrary to the binding precedent set by the Texas Supreme Court in PNC v. Howard (2023).

This appears to be an attempt at theft, and allowing the case to proceed would only further that injustice.

It should not be permitted.
