Walsh v. The Offices of Redd, Hoffman & Bramlett, LLC

(3:22-cv-00268)

District Court, S.D. Texas

JUL 26, 2022 | REPUBLISHED BY LIT: JUL 27, 2022

“As of 2/25/2022, our office would like to extend to you the option of resolving this matter through a settlement of $1,479.53. This opportunity is offered as a courtesy to assist you in fulfilling your contractual obligation and initiating a mutually agreeable resolution of your past due account balance. This would conclude a $986.35 savings.

This is a GREAT DEAL that will not be around much longer.”

Notably, Redd violates Texas Law for failure to register a valid surety bond with the State of Texas, see TFC 392.101. This is not mentioned in the class action complaint.

We are a debt collector and this is an attempt to collect a debt. Any information obtained will be used for that purpose.

Consumer debt is on the rise. If you find yourself in debt, you are not alone.

Below are some answers to frequently asked questions that will help you deal with the burden of high debt.

Working with a collection agency doesn’t have to be an unpleasant experience.

Let us help you find a way to get out from under your debt.

I received a notice from you. What do I do?

First, don’t get angry.

We have sent you a notice to alert you of a past due balance you have with one of your creditors and to advise you of your rights.

Call us immediately.

Let us know when payment can be expected.

If you cannot pay right away, we will make every effort to work with you to achieve repayment of the debt.

Failure to contact us suggests you are avoiding the debt. Through honest, sincere communication with us, we can help people out of bad financial situations.

I don’t owe the bill. What do I do?

If you believe you don’t owe the bill or have questions about the bill, please let us know.

This will allow us to respond to your questions and concerns. Ignoring the bill is your worst option.

I just can’t pay. What do I do?

Remember, we are trying to help creditors recover their past due accounts, and the best way we can do this is to help people solve their financial problems so we all win in the end.

We are experienced in credit and collections and are able to assist you if you let us.

If your account is reported to a credit bureau, this could prevent you from obtaining credit when you need it. Contact us!

We will make every effort to help you achieve a way out of your debt.

Sometimes an agreeable solution to your debt problems cannot be offered by us. Other options do exist. You can contact a not-for-profit credit counseling agency.

They usually offer counseling, workshops, education, and debt repayment plans. In most cases, their services are free. Beware of debt reduction companies that offer hard-to-believe solutions to your debt problems or “quick fix solutions” and typically charge fees for these solutions.

If it sounds too good to be true, or they “guarantee” solutions that don’t involve actually repaying your debt, it IS too good to be true.

Will my account be reported to the credit bureaus?

Yes, if your account remains unpaid at our agency for over 30 days, we will report the account to the three major credit bureaus:

Experian, Equifax, and TransUnion (see below for the credit bureau contact information).

If you have disputed the account, we will report the account as a “disputed collection account.”

After the reported account has been paid in full, the reporting will be updated to a “paid collection account.”

Can you remove an account from my credit report if I pay the bill?

In most cases, no.

As a Credit Reporting Agency, we are obligated to report accurate information in compliance with the Fair Credit Reporting Act.

If the account is paid in full, it will be updated to show a paid status and zero balance.

We will take into consideration any special circumstances surrounding the account so call us with any questions you may have.

Beware of companies who promise to “clean up” your credit report.

Don’t waste your money paying these types of companies.

If you have a legitimate issue with an item we have put on your credit report, CALL US 1-800-746-6101 !

The best way to improve your credit report is to pay your collection accounts.

Paying an outside company to send us letters will not improve your credit score.

What if I dispute an account already on my credit report?

First, dispute the item directly with the credit bureau(s).

We will be notifed of the dispute and are required to verify the accuracy of the information being reported and update any inaccuracies.

You can also contact us directly to discuss the reported account.

What forms of payment do you accept?

We accept cash, money orders, checks, credit cards, and check-by-phone payments.

Payment can be made using our online payment site, mailed to us, brought to our office, or called into our office.

What are your hours of operation?

We are open Monday through Friday, 8am to 5pm MST, with extended hours on Tuesday until 8pm MST
