On August 9, Michael Hord of H&W removed the case to federal court and a month later, there’s a stipulation of dismissal WITH PREJUDICE, (filed by Hord) and subsequently granted by Judge Hanks.

This is what happens. A hard workin’ couple feel correctly wronged by their mortgage servicer and sue in state court. But knowing the foreclosure defense fee will likely double once it’s in federal court, the creditor rights lawyers for the banks remove the case from state to federal court.

Of course, whether the lawyers represent the homeowner(s) or the bank(s), they are all colleagues, pretending to be truly independent. But lawyers are lawyers, untrustworthy snakes, and they work in concert to bleed the clients of cash (and most likely their homestead, by foreclosure) and dump ’em once they have suckered the homeowners.

LIT has proven this time and time again.

In this case, they tag-teamed this couple into spending a few hard earned thousands of dollars. The couple will walk away with a loss, and not just any loss, it’s WITH PREJUDICE to refiling (thanks to the advice of the foreclosure defense lawyer who is wanting out of this case, without a fuss and his reputation intact with the court).

Ah, y’all say, but maybe the servicer is gonna fix their issues – HELL NO – they’ll be plannin’ the next foreclosure already…
