Melanie Diane Kaimal was born on February 22, 1963 at her parents home in Jabalpur, India. She was the second child of Marlene and Narayana “Kay” Kaimal, who had sadly passed away in a car accident the previous month.

Melanie, her mother, and sister Bonnie moved to Bombay, where four years later her mother married Ed Niemiec. The family settled in Arlington, Virginia, and expanded with the birth of Melanie’s younger siblings Michelle, Sabrina, and Eddie.

Melanie attended the College of William and Mary where she studied English and French literature.

In 1986, Melanie joined Bonnie who had previously moved to Southern California.

She also met Victor while working at Security Pacific Bank, and after a comprehensive courtship married him on October 4, 1997, the same year in which Ed Niemiec passed away.

The couple took up residence in Newport Beach and saw the birth of their “one perfect child” Jack on September 24, 1998.

That year Melanie’s younger siblings also relocated to nearby Huntington Beach, where Bonnie lived, as did their mother, who lived there until her death in 2012. Melanie and Victor entertained extensively, attended Bruin Woods, and traveled with Victor’s family. 

In 2014, Melanie began volunteering at the Newport Beach Sister City Association and then, after 25 years of work as a project manager at Bank of America, she enjoyed a year off in 2016.

Melanie continued working as a project manager when she joined Union Bank in April of 2017.

Melanie was extremely proud to see her son Jack graduate from Newport Harbor High School in 2017 and the University of Oxford in 2021.

She continued to enjoy many events in downtown Los Angeles along with frequent trips to her beloved Valle de Guadalupe. 

Melanie suffered a heart attack on March 25, 2022 and passed away from complications thereof in the early hours of May 26, surrounded by family. She is survived by her husband Victor, her son Jack, and her dog Bravo.

In early celebration of what will be the 75th anniversary of the Newport Ocean Sailing Assn. next year, the mayors of Newport Beach and Ensenada met at the Bahia Corinthian Yacht Club on Friday — a meeting that officials say hasn’t happened in at least 10 years.

Newport Beach Mayor Brad Avery and Ensenada, Mexico, Mayor Armando Ayala exchanged proclamations and pins representing the emblems of their respective cities in acknowledgement of the diplomatic importance of the Newport to Ensenada International Yacht Race, which was first held in 1948.

The association was founded in 1947.

Commodore Mary Bacon said the meeting Friday was brought forward by Ayala and his staff, who have been visiting Ensenada’s other sister cities throughout Southern California, including Downey, Redondo Beach and Riverside.

Bacon said she felt the meeting was symbolic in that it allows the mayors to meet face to face and connect.

“It’s … opening the door to camaraderie and communication and setting the precedent also for the future,” said Bacon, adding that the impetus for the meeting was not necessarily because of the anniversary but is significant in relationship to it nonetheless. “I think this is a pretty big deal that they’re even doing this.”

Melanie and Victor Woodworth, who sit on the Newport Beach Sister City Assn. for Mexico, said that Newport Beach and Ensenada have been sister cities since 2006.

Next year’s race, which will take place in April, will be the 74th as the organization marks its 75th anniversary. Bacon said a celebration is planned for the end of the race that weekend.

“We are very thankful that you took the time and had the desire to meet with us about the Newport to Ensenada race,” said Avery in a toast to Ayala and the meeting. “It takes effort to keep the relationship going, to keep it solid and we really appreciate the effort that you made Mr. Mayor, Mr. Vice President … and it’s been a long time, so it’s good. Especially after COVID, it all stopped.”

“The momentum stopped, so this is very helpful for us to come together to make sure that next year — the 75th — is great and we’ll see a lot of boats and a lot of sailors,” said Avery.

Ayala said he and his staff were happy to be part of the organization for the event and to meet with Newport dignitaries.

“Seventy-five years of relationships and friends,” said Ayala.

“It’s very important to make the space to come to California,” said Ayala. “This event, it’s a little event, pero, but very important.”

YOU ARE HEREBY NOTIFIED that a settlement, the terms of which are set forth in a Stipulation and Agreement of Settlement that has been filed with the Court, has been reached in this Action with Defendants Credit Suisse Securities (USA) LLC, Deutsche Bank Securities Inc., J.P. Morgan Securities LLC, Morgan Stanley & Co. LLC, RBS Securities Inc., and UBS Securities LLC (collectively, the “Underwriter Defendants”).

Pursuant to the Stipulation, the Underwriter Defendants will cause $340 million to be deposited into a settlement fund in exchange for a release of claims by Settlement Class Members.

IF YOU PURCHASED OR OTHERWISE ACQUIRED INTERESTS IN ANY OF THE SECURITIES THAT WERE ISSUED BY THE TRUSTS LISTED ABOVE, YOU MAY BE ENTITLED TO SHARE IN THE DISTRIBUTION OF THE SETTLEMENT FUND IF YOU SUBMIT A PROOF OF CLAIM FORM ESTABLISHING THAT YOU ARE ENTITLED TO A RECOVERY.

A hearing with respect to the proposed settlement will be held on February 3, 2015 at 4:30 p.m., before the Honorable Lewis A. Kaplan in the U.S. District Court for the Southern District of New York, 500 Pearl Street, Courtroom 21B, New York, NY 10007.

The purpose of the hearing is to determine:

(a) whether the settlement with the Underwriter Defendants should be approved by the Court as fair, reasonable and adequate and in the best interests of the settlement class;

(b) whether the Court should enter an Order and Final Judgment dismissing the Action, on the merits and with prejudice, against the Underwriter Defendants, and forever barring Settlement Class Members from pursuing any Released Claims;

(c) whether the proposed Plan of Allocation for the settlement fund is fair and reasonable and should be approved by the Court;

(d) whether the application by Lead Counsel and the additional Settlement Class Representatives’ counsel (“Counsel”) for attorneys’ fees and for reimbursement of Litigation Expenses should be approved by the Court;

and

(e) to rule upon such other matters as the Court may deem appropriate.

This notice only provides a summary of matters regarding the Action and the settlement.
