We checked. As expected. No sale.

We’ve never ever seen this, a Rule 11 agreement with a separate request to dismiss without prejudice on the same day.

Remember, Vilt’s clients have been known to violate sales agreements in the past (think Robert ‘Bob’ Strange), so this creative set of filing most likely will be reneged upon, especially if the case can be dismissed without prejudice.

Will the sale occur in July?

Bookmark as we find out, if the judge and opposing counsel sign off on this bizarre and demanding proposed agreement.

GARCIA, JERRY B vs. U.S. BANK TRUST COMPANY, N.A.

(Court 270, JUDGE DEDRA DAVIS)

FEB 2, 2023 | REPUBLISHED BY LIT: FEB 4, 2023

Feb. 9, 2023

It’s good to see the careful consideration of Vilt’s motion to extend the TRO due to him “being out of state” (not the client), was granted by Judge Davis, which is clearly void as the named plaintiff is “Samuel D. Dukes”, who is in another county, Fort Bend in a separate foreclosure lawsuit. Maybe jurisdiction is ancillary in Harris County, when it’s a Bandit lawyer representing both clients in nearby counties.
