Debt Collector

There’s a Storey Behind Texas Debt Collector Shawn Grady in His Pursuit of Odin Demolition, et al

Garnishor Storey Mountain LLC, assignee of First Horizon Bank, successor by merger to IberiaBank Makes application for writs of garnishment.

LIT UPDATE

May 20, 2023

Let’s take an educated guess at what’s happened here.

LIT’s article has activated a response in federal court by James and Katherine Mitchum, statin’ that debt collectin’ lawyer Shawn Grady is not licensed to collect debts. Katherine Mitchum wrote to LIT about our article on Jan. 5, 2023.

We suggest, Grady decided – due to the money at risk – he’ll finally comply with the Texas Finance Code and obtain the necessary surety bond and file it at the Secretary of State (Feb 15, 2023) so he can file the March 28 reply, which is sealed – of course – because the judiciary don’t want LIT to read the docket filings in this case.

The sealing of records only started just before Mitchum contacted LIT. Grady would thereafter obtain and file his firm’s surety bond with TX SOS.

SEALED REPLY to JUDGMENT DEBTORS RESPONSE TO STOREY MOUNTAIN, LLCS MOTION FOR LEAVE TO FILE SUPPLEMENT RESPONSE WITH BRIEF IN OPPOSITION TO APPLICATION FOR DISSOLUTION OF WRIT OF GARNISHMENT AS TO FIDELITY BROKERAGE SERVICES LLC

LIT: What is a protective order in federal court?

ChatGPT: In federal court, a protective order is a legal order issued by a judge to protect sensitive or confidential information during the course of a lawsuit. It is designed to prevent the disclosure of information that could harm a party’s interests or compromise national security, trade secrets, or personal privacy.

Protective orders are typically sought when one or both parties in a case believe that certain documents, evidence, or information should be treated as confidential and not be disclosed to the public or the opposing party. The order outlines specific restrictions and guidelines regarding the handling, sharing, and use of the protected information.

The purpose of a protective order is to balance the need for transparency in the legal process with the need to protect sensitive information. It allows parties to freely exchange information without fear of it being used against them outside the confines of the litigation. Protective orders are commonly used in cases involving intellectual property disputes, trade secrets, sensitive financial information, or matters involving national security.

Violating a protective order can have serious consequences, including sanctions, fines, or even contempt of court charges. It is important for all parties involved to carefully follow the terms and restrictions outlined in the order to ensure compliance with the court’s directives.

LIT conducted a Search today, Friday 25 March, 2022 with the Texas Secretary of State to see if lawyer Shawn Grady is licensed and Bonded as a Debt Collector – he is not as there is no ‘Grady’ registered in Texas.

Section 392.101 of the Texas Finance Code prohibits a third-party debt collector or credit bureau from engaging in debt collection in Texas unless the third-party debt collector or credit bureau has obtained a surety bond and filed a copy of the bond with the Office of the Secretary of State.

No movement since Dec. 21 on the court docket.

ABOUT

Mr. Grady’s hometown is Houston, Texas, where he grew up and still resides with his boy, Cash. After graduation from college, Mr. Grady began his professional career in Human Resources at Enron, where he learned valuable lessons regarding business, including an introduction to shaky accounting practices. After backpacking through Western Europe, Mr. Grady began two pursuits in earnest – his legal career, as a legal assistant for a local firm that represented mortgage brokers and lenders – and writing. He spent the next six years working for creditors rights’ law firms, and honing his skills as a fiction writer, until he finally made the commitment to the practice of law, and entered law school.

From the start, Mr. Grady set his sights on litigation, taking internships at the trial and appellate level. Shortly after being licensed, he joined an insurance defense law firm in Houston, Sheehy, Ware & Pappas, P.C., a mid-sized firm of around 40 lawyers, most of whom are experienced trial lawyers. At the firm, Mr. Grady worked for long days, weeks, and years, where he learned litigation from several old trial lawyers.

Mr. Grady has extensive pre-trial and trial litigation experience in both the state and federal courts. He has handled several bench trials, by himself, and supported senior attorneys in numerous larger jury trials in state district courts. He is board certified by the American Board of Certification (ABC) in Creditor’s Rights Law.
