The Larry Poston 2024 Trust was recognized Apr. 12, 2024.
The Poston Trust “purchased” the home from the estate on that date for “sufficient consideration” per the Special Warranty Deed filed May 16, 2024. The Poston Trust is Bandit lawyer Dave Medearis and his law firm.
On May 13, 2024 Dave “sells” the property via General Warranty Deed for $192,500 (assuming the loan is 100% of sales value) to Aarons Home Investments LLC, also filed May 16, 2024.
Remember, the payoff is allegedly around $93k, so the profit is gross $100,000 to Bandit Dave.
All this happened after Dave ‘bailed’ in early February of 2024, including a rehab of the property whilst facing foreclosure in federal court.
On June 25, 2024 Judge Lee Rosenthal’s Order granted Deutsche Bank foreclosure.
In part (p. 6),
“Deutsche Bank may communicate with the defendants and third parties as reasonably necessary to conduct the foreclosure sale. Foreclosure notices may be mailed to the subject property at 16338 Clay Pigeon Court, Missouri City, Texas 77489. Deutsche Bank is awarded attorney’s fees and costs in rem, not as a personal obligation, to be collected through the foreclosure of the Property. The amount of attorneys’ fees is to be determined by subsequent motion practice. This is a final judgment.”
So how did Dave and the Larry Poston 2024 Trust obtain good title during the foreclosure lawsuit in S.D. Texas federal court, initiated by DBNTCO, and how could SCF Jake LP, aka Searchers Capital (private money lender for REI) loan $192.5k for a property owned by Larry E. Poston (deceased)?
LIT maintains, based on past case studies, it is standard practice in SDTX for legitimate and legal transactions to be conducted in front of the court. Clearly, this did not occur here and Bandit lawyer Dave was deceptive,violating professional codes of conduct, as he was conflicted. Bandit Dave’s exit from the case did not excuse his acts thereafter, it only highlights his misconduct for personal financial gain, in this case $100,000.

Aarons Home Inv. has recently relisted the property for $297,000.

TO THE HONORABLE JUDGE OF SAID COURT:
Now comes David Medearis, counsel for Defendants Amrea Marie Poston, Lorena Ann Poston, and Tiki Sundeta Poston, and brings this Motion to Withdraw as Counsel and in support thereof shows:
1. Movant is the attorney of record for Amrea Marie Poston, Lorena Ann Poston, and Tiki Sundeta Poston, and was retained to represent these Defendants in this suit.
The Initial Conference is currently set for February 8, 2024.
A copy of the Notice of Resetting is attached as Exhibit A.
The parties have previously submitted a proposed scheduling order, which counsel asks the court to enter at the conference.
The undersigned counsel also asks the court to enter an order allowing the undersigned counsel to withdraw.
2. The defendants initially hired me to assist with this case and help them to sell the subject property.
A conflict has occurred, and it is apparent that further representation to pursue the stated aim of the representation is not practicable.
The defendants have been advised of my intention to withdraw and have made no objection.
I have provided the defendants with a link to participate in the scheduling conference should they choose to attend.
3. Good cause exists for the withdrawal of David Medearis as counsel, in that the current conflict prevents good attorney-client relations.
4. A copy of this motion and proposed order is being mailed to Amrea Marie Poston, Lorena Ann Poston, and Tiki Sundeta Poston at their last known addresses, along with a copy of the Notice of Resetting.
