LIT UPDATE
OCT 25, DEC 24, 2024
It ain’t 10 years Deutsche Bank, its 4 years and y’all are time-barred. Stop thievin’ homes in Texas courts.
Y’all have relisted this home for nonjudicial foreclosure on Jan 7, 2024 for a tiny mortgage. It is predatory lending and elder abuse.
There’s no change at HCAD or HC RPR, importantly no substitute trustee’s deed, which indicates that the nonjudicial foreclosure was cancelled.
LIT COMMENTARY
The Thievin’ Continues with Another Scheduled Fraudclosure
AUG 3, 2024
The judgment date relied upon by Deutsche Bank was over 4 years ago. Despite this fact, and our article, their counsel at HWA have relisted for Aug. 6, 2024 auction. We revisited the 2019 case where the petition is sealed, and checked for probate filings for Johnell Thomas, but that returned 0 records.
This is another fraudclosure and we’ll be copyin’ @cfpb and others from our X account today to ensure this auction is cancelled and the appropriate action is taken against Deutsche Bank, their appointed foreclosure mill counsel at HWA, and their bandit lawyers.
From and including: Tuesday, September 17, 2019
To, but not including Tuesday, August 6, 2024
Result: 1785 days
It is 1785 days from the start date to the end date, but not including the end date.
Or 4 years, 10 months, 20 days excluding the end date.
Or 58 months, 20 days excluding the end date.
Regulation F prohibits any attempt to collect a time-barred debt, a foreclosure attorney can be held strictly liable for violating the FDCPA if it files or threatens to file a foreclosure action (judicial or nonjudicial) past the statute of limitations. https://t.co/haco8AKMHE

JUN 11 28, 2024
There is no evidence of a sale in the records or online (last check, Jun 28, 2024). It is presumed the sale was canceled, as with related auctions which we highlighted as time-barred.
SUPPORT LIT as we highlight the ongoing THEFT of citizens homes in Texas. Here we have a time-barred non-judicial foreclosure slated for the auction block on May 7, 2024 in Harris County for @DeutscheBank which is plainly an illegal taking: https://t.co/Fcx6AzqMtt #TWO #NMA pic.twitter.com/dYK2ry92Xk

APR 27, 2024
HWA foreclosure mill lawyer Anthony Garcia is knowingly stealin’ from the estate of the Thomas family. Johnell is deceased a his wife, Ollie is named in the foreclosure proceedings and this notice of sale. It’s so brash that the notice actually lists the time-barred judgment it relies upon from September 17, 2019, which is over 4 years old. LIT’s checked for bankruptcies since this judgment was issued and there is none showing at the time of this article.
