Currytown Corruption in Texas: Investigating Dr. Guru Reddy’s US Healthcare Fraud and Indian Hospitals

It is clear and obvious from the collated facts that between 2007 and 2013, when the Hyderabad Continental Hospital was founded by Doc. Guru Reddy, he’d most likely unlawfully skimmed the funding requirements from medicaid and medicare with fraudulent billing and as the whistleblower claims, circumvented the procedures he was paid for by providing inferior care and skimping on expenses.

Dr. Guru N. Reddy bled the American government and American citizens with his premeditated schemes, and then relied upon his resume and high-powered connections when criminal charges were brought in 2017 to ensure they would be dismissed.

In an article below from as recently as last year, Guru Reddy is already stating that he’s renounced Texas for his love of his country, India, and ensuring the healthcare of his own people. However, he professes to want to implement the systems he learned from Texas and the Mayo Clinic. That stated, there is strong evidence Dr Reddy has left firm roots in Texas, and no doubt is still bleeding the system which has been so financially rewarding to him and his business interests.

Perhaps he’s now decided to become a permanent resident in India after this recent $55 million dollar Healthcare fraud  and 20 year jail sentence for a nurse practitioner by the name of Trivikram Reddy. No relation, we assume? And how does a nurse practitioner get his hands on $55 million?

U.S. Attorney’s Office, Southern District of Texas

HOUSTON – Dr. Gurunath Thota Reddy (aka Guru Reddy), Memorial Hermann Endoscopy and Surgery Center North Houston, United Surgical Partners International and Digestive & Liver Disease Consultants P.A. have entered into an agreement to pay $1,575,000 to settle allegations of Medicare fraud, announced Acting U.S. Attorney Abe Martinez and Special Agent in Charge C.J. Porter of the Department of Health and Human Services – Office of Inspector General (DHHS-OIG).

The claims resolved by this settlement are only allegations and there has been no determination of liability.

The Medicare claims included in the settlement date from April 1, 2007, through Nov. 30, 2014.

An endoscopy nurse formerly employed by Memorial Hermann Endoscopy and Surgery Center initialed the matter.

She alleged that Reddy and other physicians who performed colonoscopies at Memorial Hermann Endoscopy and Surgery Center North Houston failed to meet established medical standards.

She claimed Reddy and other physicians performed procedures at the center so quickly that they were essentially worthless. By failing to take the necessary amount of time to closely examine the colon, precancerous lesions could be missed.

She also claimed that, in the interest of saving time, the physicians would not always examine the entire colon and would sometimes spend as little as two minutes on a colonoscopy. She also alleged the surgery center did not follow established guidelines for sanitation, claiming Reddy would not put on a clean gown prior to each procedure in order to save money.

“When Medicare pays for a patient to undergo a medical procedure, Medicare expects the health care provider to follow established medical standards of care and sanitation,” said Martinez. “There is no excuse for shortcutting quality in order to increase revenues.”

“Boosting profits with shortcuts to standard medical procedures is unacceptable and at the expense of patient safety,” said Porter. “Working with our law enforcement partners, we will continue to protect Medicare and Medicaid patients from substandard care.”

The experienced endoscopy nurse who brought the allegations further claimed she was fired the day after she complained to the Regional Vice President of United Surgical Partners about the problems she observed.

The FBI, DHHS-OIG and investigators for the U.S. Attorney’s Office conducted the investigation. Assistant U.S. Attorney Michelle Zingaro handled the litigation on this matter.

Illegal trade: Kidney scamster, Continental Hospital signed deal

Hyderabad, India: Investigation into the kidney racket involving staff members of the Continental Hospital, Nanakramguda, has revealed the startling fact that the gang leader of the kidney trade in Bangladesh had struck a “facilitation” agreement with Continental Hospital to expand its patient base.

Tareque Azam Choudhary of Choto Hossainpur Rajganj in Begumganj Upazila of Noakhali district in Bangladesh, was arrested in September 2011, in Dhaka, and charged with collecting kidneys from 30 poor Bangladeshi persons and selling them to patients in Singapore, Chennai and Vellore.

In July 2016, Continental Hospitals Limited signed an agreement with “health care facilitator” Tareque Azam to pay him 20 per cent of the treatment bill as a “facilitation fee”.

The agreement said that Mr Azam is in the medical tourism industry and provides a diverse range of health care facilitation services, including sending patients to medical institutions, aiding travel and accommodation arrangements, organising payments of treatment and diagnosis.

In the agreement, the hospital agreed to indemnify and hold Mr Azam harmless against any claims or suits brought by any third party against Continental Hospital arising out of the obligations under the agreement.

The agreement was signed by Gokul Prem Kumar, the GM of International Marketing of Continental Hospital.

The agreement came under the scrutiny of the police and Directorate of Medical Education and the Gachibowli police issued an FIR under the Human Organ Transplantation Act, accusing three staffers of Continental Hospital, including Gokul Prem Kumar, of cheating and forgery.

Kidney scamster placed ads to lure donors

Asked to comment on the matter, Gokul Prem Kumar, the general manager of International Marketing of Continental Hospital, told this newspaper that at the time of signing the agreement he was not aware of Mr Azam’s background in selling kidneys.

“We were not aware of his background when we entered into an agreement with him. After four or five transplantations facilitated by him, we came to know about his background and stopped dealing with him. In February, the City Task Force also enquired about him. However, as an individual I am not supposed to communicate (with you). The hospital communications department will give complete details.”

According to investigations, Tareque Azam alias Bablu Chowdhury has been a key figure in the illegal kidney business in Dhaka and Joypurhat district in Bangladesh since 2006. He had arranged transplants for around 30 persons, receiving Rs 3-4 lakh taka per transplant, while the kidney donor was paid only a paltry sum.

He was arrested by the Dhaka police on September 8, 2011, and a case was booked against him by the Kalaiupazila police in Joypurhat.

It was alleged that he had inserted an advertisement stating that his cousin needed a kidney donor and then lured those who came forward into selling their kidneys.

Kidney transplantation case: Forgery case filed against Continental Hospital

Police are now probing whether the Bangladeshi live donor and the recipient of the kidney transplant are related.

Hyderabad, India: Gachibowli police have booked a case of forgery and under the Transplantation of Human Organs Act against Continental Hospital but has now sought information from the TS Director of Medical Education on how to proceed further.

The case pertains to alleged irregularities in a kidney transplantation case. An FIR was issued based on a complaint filed by Dr Praveen Kumar, formerly of the Nephrology department of the hospital, who alleged that his signature was forged on the ‘forward note’ that establishes that the donor and receiver are related.

Police are now probing whether the Bangladeshi live donor and the recipient of the kidney transplant are related.

Gachibowli inspector S. Chandrakanth said a case has been booked against the hospital and a request has been sent to the director of medical education for the records.

Gachibowli SI K. Rajender said that a three-member internal committee of the hospital has to conduct a compatibility test and test for establishing the biological relationship between the donor and recipient and then send a forward note to the Transplant Authorization Committee of the Director of Medical Education.

“The allegation is that the complainant, Dr Praveen, who was part of the internal committee, did not approve the forward note. He rejected it saying the donor and recipient are not biologically related. We are sending the original signature of the complainant and signatures on the forward note to the Forensic Laboratory. We are awaiting a reply from the DME and then we will know whether the kidney transplantation was done and whether there are violations,” Mr Rajender said.

Continental Hospital has a Centre for Kidney Diseases & Renal Transplant which does a large number of transplantations every year.

Continental claims that everything is legal. In a statement, the hospital said,

“Continental Hospital wishes to emphasise that all organ transplants were done following laws. All transplants were conducted after receiving approvals from authorities, including the Transplant Authorisation Committee, DME, Ministry of Health, Telangana…

The Hospital is not aware of any FIR being filed against the Hospital or any nephrologists.

Any such allegation is false and any complaint made by Dr Praveen against the hospital or its employees will be dealt with appropriately.

Further, on Dr Praveen, the hospital wishes to highlight that there were several disciplinary issues pending against him at the time of his resignation. The Hospital is investigating and will take action.”

When contacted, Dr Praveen Kumar refused to divulge details of his complaint and said, “Let the law take its course.”

Asked about the hospital’s allegation of disciplinary proceedings against him, he said, “It is nonsense on the part of the hospital personnel.”

Dr. Guru N. Reddy received his training in Gastroenterology, Liver Diseases and Nutrition at Baylor College of Medicine in Houston, Texas.

He completed his Fellowship in 1988.

For his professional contributions and achievements in the field of gastroenterology, Dr. Reddy is regarded as an icon in his specialty.

He is recognized as an excellent clinician, superb endoscopist, champion of empathetic patient care and is the recipient of several awards and accolades.

Dr. Reddy is voted to Houston’s Top Doctors and recognized in “Top Docs”, H-Texas Magazine consecutively from 2006 – 2019, as well as Houstonia Magazine 2013 – 2018. His comprehensive training also in Liver diseases (Hepatology) and Liver transplantation at Baylor College of Medicine, facilitated him to develop a very large liver practice. Dr. Reddy was elected to serve as “Chief of Staff” of Houston Northwest Medical Center, Memorial Hermann Northeast Medical Center Hospital, Icon Hospital and also served on the boards of these hospitals.

He is also the Founding Board Member of Kingwood Medical Center.

Dr. Reddy has been elected to serve as President of Houston Academy of Medicine in the year 2008 and President of Harris County Medical Society in the year 2011.

Guru N Reddy, Chair and Managing Director of Continental Hospitals, has inspired sweeping changes in perspectives and practices, with the aim to make Continental Hospitals the poster child for new-age Indian health care.

And while Guru has had a long and successful career abroad, which includes several leadership achievements in America – the first Asian president of the largest county medical society in the country, President of Houston Academy of Medicine and serving as the Chair of Hospital Council Chiefs of Staff of 83 hospitals – he says the most important work is what he is doing right now.

“At the end of the day, all those accolades mean nothing. I gave up a glorious career in the West for the primary purpose of giving back to my country and reforming health care in a way that is urgently needed in our country. For me, patient dignity and their safety were the biggest priorities in building Continental,” he tells The CEO Magazine.

The first thing he did was study existing hospitals in India and what ails them. He discovered that India needed a true, well-designed and statutorily compliant facility based on innovative healthcare infrastructure, digitisation and patient friendliness.

“We were the first hospital to get Joint Commission Accreditation within two years – no other hospital in the world is given accreditation within two years of opening,” he says proudly. “We also got our national accreditation, which is NABH, within 18 months.”

Health care with a difference

Thanks to his close ties with global healthcare facilities, Guru made Continental a story of firsts. It’s one of the rare Indian hospitals that used electronic medical records from day one.

“I digitized Continental for three reasons,” he explains. “One, to enforce quality; two, to avoid duplication of tests; and three, to prevent the chit system whereby people write a few sentences on a piece of paper and the patient takes that as their record. This is often not brought back with the patient the next time and then even if it is the doctors often are unable to even understand what has been written.”

He also hand-picked doctors from non-resident Indians operating in the UK, US and Australia, from leading Indian institutions such as the All India Institutes of Medical Sciences, the Postgraduate Institute of Medical Education and Research and from regional centres. “This amalgamation helped me. Each of these groups brought their cultural aspects in terms of patient care and each learned from the other.”

As an advocate of preventive care, Guru mandated that all doctors take detailed health checks and patient histories, and then use the notes as the starting point. “Health checks are meant to establish a relationship with a primary care physician so that you can have a holistic approach and understand how you can prevent future risks and not simply run a battery of tests,” he explains.

Medicine has advanced so much that a single physician can’t stay abreast of it and do justice to the patients.

The digitised infrastructure helped him to promote a truly collaborative ecosystem for doctors, preventing unnecessary complications while reducing average hospital stays to 3.5–3.9 days, which in turn helped reduce their risk of hospital-acquired infections.

“Collaborative care has helped me and the institution on many occasions because physicians should not work in silos in today’s world. Medicine has advanced so much that a single physician can’t stay abreast of it and do justice to the patients.”

To this end, Guru wants to build a strong group of general physicians as primary care providers. Specialist and super specialist doctors are a value-add in the institution while working closely with primary care providers. If the income gap is bridged, primary care doctors can become the gatekeepers of Indian health care.

Challenges abound

Guru’s strong ideas are, however, frequently met with stronger challenges. He is critical of the fractured and poorly thought-out mandates such as capping the prices of prosthetics and controlling certain critical drug prices by the National Pharmaceutical Pricing Authority. This has disadvantaged both providers and patients due to the constraints of operational costs.

For him, the other issue is the unsustainable poaching of established doctors in hospitals in India. “This is artificially driving the prices, and patients have to bear the brunt of it. Indiscriminate compensation and inducing doctors to volumetric care is affecting delivery of care with ethics. This needs to be checked and there has to be some guidelines to prevent gouging,” he asserts.

Hospitals dependent on bailouts from international companies that don’t improve, or participate in innovation, will only contribute to the rising cost of health care.

According to Guru, the problems can be traced back to foreign companies coming to India solely to make undue profits. “Hospitals dependent on bailouts from international companies that don’t improve, or participate in innovation, will only contribute to the rising cost of health care.”

But Guru has shielded Continental by being hands-on with equipment sourcing and sharing a close bond with the suppliers with his scientific knowledge.

The hospital has the latest and greatest equipment from GE Healthcare and Siemens – as long as they benefit patients.

He’s overseeing the installation of an additional five new large modular theatres manufactured by the German team of KLS Martin.

He is proud of Continental OT’s safe infrastructure.

“Do not buy medical equipment as a gadget to make money; do it with a full understanding and necessity,” Guru says emphatically.

Providing the best

His decades of US experience also gave him a significant edge when it comes to sourcing the best quality materials. One example would be buying anaesthesia machines recently for expansion from Mindray, a Chinese company that is very popular in the US because of its quality and high standards.

Guru also prioritised patient care by purchasing expensive endoscopy equipment recently from Olympus, a rarity in Indian health care, to facilitate complex diagnosis and therapeutics. The other key suppliers include Smith & Nephew, Boston Scientific, Paramount, Stryker, Ethicon, Medtronics and Pentax. Overall, Continental has 100 key suppliers across 30 specialties.

Right from the get-go, Guru has differentiated Continental as a Tertiary/Quaternary care hospital, modelled after Mayo Clinic centres and Texas Medicare Center, where patients reach out when they have been failed elsewhere.

“In a nutshell, my future vision would be to continue to consolidate Continental with the best doctors, best nurses and best ancillary staff – and make it the Mayo Clinic of the East,” he says.
