A Houston judge denied a mortgage company’s attempt to repossess a home from a Hispanic couple, stating the original contract was “written in such a way to perpetuate a fraud.”
The contract by First Capital Interests also tried “to take advantage of the lack of knowledge, expertise or use of the English language” of Felipe and Maria Gonzalez, according to an order signed by Harris County Court-at-Law Judge Gary Michael Block.
The lengthy contract stated the couple would lose possession of the home if payments were late without any recourse, according to James R. Walker, attorney for the Gonzalez family.
“They are mostly Spanish-speaking individuals. No one explained the provisions to them in Spanish,” Walker said. “They had been paying on this home since May 1989 and only had a year left before it was fully paid off.”
First Capital Interests listed its agent as Danny Hilal, the same person who bought the home of an 82-year-old widow for $5,000 at a foreclosure auction.
In that case, Hilal refused to sell it for $50,0000 to The Champions Community Improvement Association so it could give the home back to Wenonah Blevins.
That case remains pending.
Hilal could not be reached for comment today about the Gonzalez case.
A person who answered the phone at First Capital Interests said, “We have no comment.”
Walker said the Gonzalez family had been paying $260 a month for the past dozen years for the modest home in the 7000 block of Dayton.
“It was only until the last year when it was almost paid off that Mr. Hilal claimed that he never received payments for several months, although the Gonzalezes said the checks were sent,” Walker said.
“They are not sophisticated or articulate, but they are honest and hard-working. They didn’t want to lose their home,” Walker said.
The judgment stated the $3,818 that the Gonzalez family placed in the court’s registry was adequate to pay any outstanding balance. It also ordered Hilal to transfer the warranty deed to the Gonzalez couple.
“They are very pleased,” Walker said.
But they were not comfortable in making public statements themselves, he said.
