LIT UPDATE & COMMENTARY
SEP 3, 2024
The case would be voluntarily dismissed in April of 2023 and a month later a loan mod agreed, with the original loan of $112.8k now amended to $305.8k – $193k increase. The home is currently valued on HAR as $290.8k, so Coleman is underwater already. The loan matures in 2036 and there’s’ a balloon payment of $177k due at maturity.
Importantly, this would not be recorded by SPS in real property records until Jan 17, 2024.

COLEMAN, ROSIE L. vs. DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE,
(Court 269, JUDGE CORY SEPOLIO)
MAR 6, 2023 | REPUBLISHED BY LIT: MAR 6, 2023
The storyline behind this foreclosure case is quite a lengthy one. It pertains to erie guesses by the Court of Appeals for the Fifth Circuit (federal), HELOC Loans and the Texas Constitution. Ultimately, it resulted in Lane Law Firm being wrongly sanctioned by Judge David Hittner, a federal judge in Rusk St, Houston Div’n for several foreclosure defense lawsuits that were filed or removed to the Southern District Court. You can read all about it on LIT – the case which decided the federal court’s erie guess was wrong is Priester, but that still didn’t save the homeowners from wrongful foreclosure.
