From Erick Delarue to Dave Medearis , the legal bandits line up as counsel for MJM/Plaster as the case currently ping pongs between Homeowner and Michael Hord for Lender/Servicer, TRO’s and foreclosure auctions.

August 2024: Stop foreclosure $100 cash bond

May 2024: Stop foreclosure $100 cash bond

Nov 2023: Stop foreclosure $100 cash bond (it shows no bond paid, yet was also extended, fyi)

The property was slated for July foreclosure auction, but now it’s been relisted for Aug 6, 2024 foreclosure auction.

LIT notes that the foreclosure Wolves of Texas July 2 auction postings includes the MJM/Plaster case we’ve published here.

Despite the case being closed, the purported wire that Dave Medearis claimed had been wired in full satisfaction of the current loan, clearly did not clear the debt as the home’s up for non-judicial sale again.

In the alternative, they didn’t pay the mortgage payments on the new loan…

Foreclosure mill lawyer Horde set his motion for summary judgment for Jan 29, 2024 by submission.

Two days later, while that motion was still pending, foreclosure defense lawyer Medearis nonsuited without prejudice on Jan 31, 2024.

Next, Medearis files a new lawsuit  on Feb 5, 2024 and files for a new TRO with a bond of $100, signed off by Judge Robert Schaffer (ancillary judge) on the same day. The new case is before Judge Tanya Garrison, but that should be transferred back to Judge Christine Weems.

The facts of the new petition by Plaster/MJM c/o Dave Medearis state that the required payoff of the mortgage has been wired to the lender, and thus this filing is a precaution as the home was reslated for auction on Feb. 6, 2024.
