Dexter’s One Year Construction Loan Has Been Accelerated and Realtor Lucretia Ain’t Happy

RULE 11 AGREEMENT

TO THE HONORABLE JUDGE OF SAID COURT:

COMES NOW, Plaintiff DEXTER TAYLOR, and Defendant FCI LENDER SERVICES INC, in the above-styled and numbered cause and file this Rule 11 Agreement.

The attorney’s signatures on this document are evidence of their intent that the document be enforceable upon filing with the Court pursuant to Rule 11 of the Texas Rules of Civil Procedure, as follows:

1.      The Parties announce to the Court that they have reached an agreement that settles all matters between the Parties with respect to Plaintiff’s underlying loan.

2.      Defendant agrees that it will pull the property described in Plaintiff’s Original Petition from the foreclosure sale on February 6,2024.

3.      Plaintiff will file a dismissal with prejudice upon execution of this Agreement.

4.      Subsequent to the execution of this Agreement, Plaintiff agrees not pursue, file, or otherwise seek to obtain any Temporary Restraining Order, Temporary Injunction, other injunctive relief or any actions that would stay a future foreclosure sale set by Defendant or its successors.

5.      Defendant will post the subject property for the March 5,2024 Trustee’s sale.

6.      The parties agree that the terms of this Agreement are binding upon their representatives, and assigns.

7.      The parties agree that the Court will retain jurisdiction to interpret and enforce this Agreement.
