Alert: Harriet Nicholson Attends Zoom Court On Monday for A Thanksgiving Hearing

After the ‘bench retirement’ of Judge David Evans, this zoom conference is now being held in another court, the 192nd in Texas.

Harriet Nicholson attended the remote hearing and things just didn’t feel right. First, there was a ‘visiting judge’ assigned, Senior Judge Ray Wheless who Ms Nicholson maintains had determined his decision at the onset hearing, based on his thoughts without any basis in fact or law.

Judge Ray Wheless is formerly a judge on the Collin County District Court. Incidentally, he did not pass the certification exam in criminal trial law in 2007, according to public records.

Ms Nicholson had filed a Motion for Summary Judgment in the 192nd District Court of Dallas County, Texas which was heard by Judge Wheless. He appeared almost twenty minutes late, with a predisposed mentality and he denied the motion. However, Judge Wheless failed to sign the order, although one was filed by Defendant.

Ms. Nicholson sent a letter to the court on Nov. 24, 2021 asking the Court for a signed order. On November 29, 2021, she filed a Motion to Rule on the Motion for Summary Judgment.

During the interim, without a signed order, Nationstar Mortgage filed a Motion to Declare Plaintiff Nicholson a vexatious litigant, which stays the case automatically in Texas law.

After this, Ms Nicholson went on to perform a detailed docket audit and this investment in time generally proves beneficial in LIT’s experience. It did so here, as well.

Based on the information in her next filing, Ms Nicholson would request recusal of both the visiting judge (Wheless) and the sitting judge (Williams). Both would recuse by signed orders on Dec. 7, 2021

Harriet Nicholson’s renewed zoom hearing scheduled for tomorrow, Monday 22nd November at 10.45 am in the 192nd District Court, Dallas County, Texas. The conference is to address Nicholson’s Jurisdictional Challenge to Vacate Void Judgments rendered by Retired Judge David Evans in the 48th District Court in case 048-276347-15.
