LIT anticipated a settlement in this case, based on the arguments presented by defendant’s counsel. The Wall Street debt buyer sued past the statute of limitations for ANY necessary defendant.

The way the dismissal and void  clerk’s entry of default is integrated into the docket is just smoke and mirrors.

The agreement clearly states that PLAINTIFF is dismissing the case WITH PREJUDICE, and the default entered against Evelyn Collins is void (expired statute of limitations).

Furthermore, Mackie Wolf’s lead attorney, Mark Cronenwett has left, be it temporary or otherwise, and obtained a role with Lewis Brisbois, which we’ve commented on during our X posts on our social media account.

He left before this “Joint Stipulation” was ever written or submitted. We suggest he probably was departing or had left the pack when Nick Frame from Houston appeared on April 12, 2024. Yet, like typical wolves, the law firm did not disclose this to the court and submit the relevant pleadings.

Plaintiff Select Portfolio Servicing, Inc. (“Plaintiff” or “SPS”) and Defendants Jose N. Estrada, Juan O. Martinez, Marria A. Martinez, and Maria O. Martinez (“The Estrada-Martinez Defendants,” and together with Plaintiff, are referred to hereafter as the “Parties”) file this Joint Stipulation of Dismissal With Prejudice and show:

The Parties have agreed to dismiss this case with prejudice as to Defendants Jose N. Estrada, Juan O. Martinez, Maria A. Martinez and Maria O. Martinez.

As such, the Parties respectfully request that the Court sign an order of voluntary dismissal with prejudice as to the claims brought by the Plaintiff in this action against these Defendants, ordering that:

1.                    this Joint Stipulation of Dismissal With Prejudice is granted;

2.                  all of Plaintiff’s claims in this action against Defendants are dismissed with prejudice;

and

3.                  that each party will bear its respective costs.

The foregoing is stipulated by the Parties by and through their respective counsel of record.

WHEREFORE, PREMISES CONSIDERED, the Parties request that this matter be dismissed with prejudice.

The Parties also ask for such other relief to which the Parties may be justly entitled.

Plaintiff Select Portfolio Servicing, Inc. (“Plaintiff” or “SPS”) and Defendants Jose N. Estrada, Juan O. Martinez, Marria A. Martinez, and Maria O. Martinez (“The Estrada-Martinez Defendants,” and together with Plaintiff, are referred to hereafter as the “Parties”) file this Follow- Up Joint Status Report, as directed by the Court.

I. “PROPOSED SETTLEMENT”

The “proposed settlement” referenced in the Parties’ prior Joint Status Report is actually an offer to provide information in exchange for an agreement to dismiss the claims against the Estrada-Martinez Defendants.

As stated by the Estrada-Martinez Defendants in the prior Joint Status Report:

“The Estrada-Martinez Defendants contend Plaintiff failed to comply with the Order in that no response or supporting brief of any kind was submitted.

Instead, Plaintiff filed its First Amended Complaint,

adding Section VI., a “Matter of Avoidance,” suggesting that the Estrada-Martinez Defendants “are not bona fide purchasers for value because they did not acquire the property for value.”

In the only apparent attempt made to support this suggestion, Plaintiff states in its First Amended Complaint that

“[t]hese Defendants acquired the property for $100.00 per the General Warranty Deed filed in the Real Property Records of Dallas County, Texas.”

Plaintiff did not, in any capacity, challenge the facts and legal arguments put forward by the Estrada- Martinez Defendants establishing that Plaintiff’s claims are barred by limitations.”

The Estrada-Martinez Defendants, although the Parties have not yet initiated discovery, have offered to deliver documentation to Plaintiff establishing that the Estrada-Martinez Defendants purchased the property in question for value in excess of that alleged by Plaintiff in paragraph 7 and paragraphs 37 through 39 of the Amended Complaint,

in exchange for a full dismissal of the claims brought by Plaintiff against the Estrada-Martinez Defendants.

As of the submission of this Follow-Up Joint Status Report, Plaintiff’s counsel is waiting on a response from Plaintiff concerning the foregoing proposal.

Sutton Funding LLC is a financial company based in New York City.

They provide working capital to small and medium-sized businesses.

Since their inception, they have worked with thousands of clients and funded over $100 million.

Interestingly, Sutton Funding LLC has been involved in the mortgage-backed securities (RMBS) market.

For instance, they were the seller and sponsor for a non-prime RMBS transaction called Barclays Mortgage Loan Trust 2021-NQM1.

In this transaction, non-QM loans made up about 67.18% of the pool, and 22.27% of the pool consisted of exempt investor property loans.

The total note balance, including unrated classes, was $244,200,597.

The transaction was expected to close on November 23, 2021
